Section 01 Acceptance of Terms
By accessing or using the AnthologyRX website, mobile experience, or any services made available through anthologyrx.com (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms and conditions that may apply to specific services or features.
If you do not agree to these Terms in their entirety, you must not access or use the Platform. Use of the Platform constitutes your affirmative acceptance of these Terms.
- You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are 18 years of age or older. Use of the Platform by anyone under 18 is strictly prohibited.
- You must be a legal resident of the United States residing in a state where AnthologyRX is authorized to facilitate telehealth services and where the requested treatments are legally available.
- You represent that all information you provide to AnthologyRX or to any independent licensed provider is accurate, current, and complete. Providing false or misleading information may result in termination of your access and may expose you to legal liability.
Important: These Terms constitute a binding legal agreement between you and AnthologyRX. If you are a resident of a state where telehealth services of this type are restricted or unavailable, you may not use the Platform to seek clinical evaluation or obtain prescriptions.
Section 02 Telehealth Services
AnthologyRX is a technology platform that connects patients with independent, licensed healthcare providers. AnthologyRX is not itself a medical provider, physician practice, pharmacy, or licensed healthcare facility. AnthologyRX does not practice medicine or any other licensed healthcare profession.
All clinical services available through the Platform are provided by independent licensed providers who practice through Bask Health's clinical infrastructure. These providers are solely responsible for all clinical decisions, including whether to evaluate a patient, what (if any) treatment to recommend, what medication to prescribe, and at what dosage.
- The provider-patient relationship exists exclusively between you and the independent licensed provider who evaluates and treats you. AnthologyRX is not a party to that relationship.
- AnthologyRX does not control, direct, supervise, or interfere with the clinical judgment or professional decisions of any independent provider.
- Your use of the Platform does not establish a physician-patient relationship with AnthologyRX or any of its employees, officers, or affiliates.
- Communications made through the Platform with providers are subject to the provider's professional and ethical obligations and applicable law. AnthologyRX cannot guarantee the confidentiality of any communications to the extent required to be disclosed under applicable law.
Bask Health provides the clinical infrastructure and technology that supports the licensed provider network. References to "clinical services" on the Platform refer to services delivered by independent providers operating through this infrastructure, not by AnthologyRX itself.
Section 03 Eligibility & Assessment
Access to prescription treatments through the Platform requires the completion of a health intake assessment ("Assessment"). The Assessment is designed to gather relevant health information that an independent licensed provider will review to determine whether a clinical evaluation is appropriate and whether a prescription may be issued.
- You must complete the Assessment honestly and in full. Incomplete or inaccurate responses may compromise the safety of any treatment plan and constitute a material breach of these Terms.
- Completion of the Assessment does not guarantee that you will be approved for any treatment. Each application is independently evaluated by a licensed provider based on clinical criteria, your disclosed health history, and applicable prescribing guidelines.
- Approval is not guaranteed. The licensed provider has sole and absolute clinical discretion to approve, deny, modify, or discontinue any treatment plan. AnthologyRX does not influence or override provider clinical decisions.
- Providers may request additional information, documentation, or lab results before making a prescribing decision. Failure to provide requested information in a timely manner may result in denial or delay of your evaluation.
- Even if you have been previously approved, a provider may deny renewal or continuation of a prescription based on updated health information, changes in clinical guidelines, or other clinical considerations.
AnthologyRX reserves the right to deny or restrict access to the Platform at any time for any user who does not meet eligibility requirements, who provides false information, or who misuses the Platform in any manner.
Section 04 Subscription & Billing
AnthologyRX offers access to treatment programs through a monthly recurring subscription. By enrolling in a subscription, you authorize AnthologyRX (or its designated billing processor) to charge your payment method on a recurring monthly basis at the applicable rate until you cancel.

Auto-Renewal Disclosure: Your subscription will automatically renew each month, and your payment method will be charged at the applicable monthly rate, until you cancel. You will not receive a separate notice before each renewal charge.
- Billing cycle: Your subscription billing date is established at initial enrollment. Each subsequent charge occurs on the same calendar day each month (or the nearest available date for shorter months).
- Cancellation: You may cancel your subscription at any time through your account dashboard or by contacting legal@anthologyrx.com. To avoid being charged for the next billing period, you must cancel before your next scheduled billing date.
- Effect of cancellation: Cancellation takes effect at the end of your current paid billing period. You will retain access to your subscription benefits through the end of that period. AnthologyRX does not provide partial refunds for unused days in a billing cycle.
- No refunds on dispensed medications: Once a prescription has been dispensed and shipped by the compounding facility, no refunds will be issued for that order. This policy applies regardless of whether the medication has been used, opened, or received, due to the nature of compounded prescription products and applicable pharmacy regulations.
- Pricing changes: AnthologyRX reserves the right to change subscription pricing at any time. If pricing changes affect your active subscription, you will be notified at least 30 days in advance, and the new price will apply at your next renewal date following the notice period.
- Payment failures: If a payment method fails, AnthologyRX may make additional attempts to process payment. If payment cannot be collected, your subscription and any associated prescription services may be suspended or terminated until payment is resolved.
Section 05 Compounded Medications
Medications dispensed through the AnthologyRX platform are compounded medications prepared by a licensed 503B outsourcing facility in accordance with applicable federal and state laws governing pharmaceutical compounding.
FDA Disclosure: Compounded medications are not FDA-approved drug products. Compounded medications have not been reviewed or approved by the U.S. Food and Drug Administration (FDA) for safety, efficacy, or quality. They are not equivalent to FDA-approved brand-name or generic medications bearing the same active ingredient name.
- The safety and effectiveness of compounded medications have not been established through the FDA drug approval process. Individual clinical outcomes may differ from those associated with FDA-approved medications.
- Compounded medications are not a substitute for FDA-approved medications where such medications are commercially available and appropriate for you. Your provider will use independent clinical judgment in determining what is appropriate for your individual situation.
- All compounds dispensed through the Platform are prepared by a licensed 503B outsourcing facility, which is subject to FDA oversight and must comply with Current Good Manufacturing Practice (cGMP) regulations. However, compliance with cGMP regulations does not constitute FDA approval of the compounded product.
- Results vary. No outcome is guaranteed. Individual responses to compounded medications depend on a wide range of factors, including health status, adherence to the treatment plan, dosage, lifestyle, and other variables. Testimonials, case studies, and representative results shared on the Platform are not typical and should not be interpreted as a promise or guarantee of similar outcomes.
- Compounded medications must be stored as directed on the packaging. Improper storage may affect the safety, sterility, and potency of the medication. Responsibility for proper storage following delivery rests with the patient.
- You must report any adverse effects, allergic reactions, or unexpected symptoms to your provider promptly. In the event of a serious adverse event, seek immediate emergency medical care.
Section 06 Not Emergency Services
The AnthologyRX Platform is not designed, staffed, or equipped for emergency medical situations. The Platform is not an emergency service.
If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room. Do not use the AnthologyRX Platform or attempt to contact a provider through the Platform in lieu of calling emergency services.
- Providers on the Platform cannot dispatch emergency services, contact your local emergency responders on your behalf, or provide real-time emergency medical intervention.
- Response times on the Platform are not immediate. Telehealth consultations and provider review of intake forms are not conducted in real time and are not appropriate for time-sensitive or life-threatening conditions.
- If you believe you may be experiencing a serious or life-threatening condition — including but not limited to chest pain, difficulty breathing, signs of stroke, severe allergic reaction, or uncontrolled bleeding — stop using the Platform and seek emergency care immediately.
- AnthologyRX is not responsible for any harm resulting from a user's failure to seek appropriate emergency medical care.
Section 07 Provider Independence
All licensed healthcare providers who evaluate patients and issue prescriptions through the Platform are independent contractors, not employees, agents, or representatives of AnthologyRX. AnthologyRX does not employ physicians or other licensed clinical practitioners in any capacity that subjects them to the direction or control of AnthologyRX in the exercise of their professional clinical judgment.
- Each provider exercises sole, independent clinical judgment in evaluating patients, making diagnoses or clinical assessments, and determining whether to issue, modify, or decline a prescription.
- AnthologyRX does not review, approve, override, or direct any individual prescribing decision made by an independent provider.
- AnthologyRX is not responsible for the clinical acts, omissions, errors, or decisions of any independent provider. Any claims arising from clinical care should be directed to the applicable provider and, where relevant, to their professional liability insurer.
- The clinical infrastructure and provider network are facilitated through Bask Health. The terms and conditions of clinical service delivery are governed in part by the provider's agreement with that infrastructure.
Section 08 Intellectual Property
All content on the AnthologyRX Platform — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the overall design and compilation of the Platform — is the exclusive property of AnthologyRX or its content suppliers and is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.
- The "AnthologyRX" name, logo, brand marks, and all related names, logos, product and service names, designs, and slogans are trademarks of AnthologyRX. You may not use these marks without our prior written permission.
- You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use only. This license does not include any right to: resell or commercially exploit the Platform or its content; reproduce, duplicate, copy, or otherwise exploit any portion of the Platform for commercial purposes; or download or copy account information for the benefit of another person or entity.
- Any unauthorized use of Platform content terminates the limited license granted by AnthologyRX and may violate copyright, trademark, and other applicable laws.
Section 09 Disclaimer of Warranties
THE ANTHOLOGYRX PLATFORM AND ALL SERVICES, CONTENT, MATERIALS, AND PRODUCTS MADE AVAILABLE THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANTHOLOGYRX EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- Any warranty that the Platform will be uninterrupted, timely, secure, or error-free.
- Any warranty regarding the accuracy, reliability, completeness, or usefulness of any content, information, or material on the Platform.
- Any warranty that the results obtained through use of the Platform, including clinical outcomes, weight loss results, or improvements in health markers, will meet your expectations or requirements.
Individual outcomes from any treatment vary substantially based on health status, adherence, lifestyle factors, dosage, and other variables. No representation or warranty is made that any treatment made available through the Platform will produce any particular result for any particular user. Statements about potential outcomes are for illustrative purposes only.
Section 10 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANTHOLOGYRX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, SUBCONTRACTORS, SUPPLIERS, OR SUCCESSORS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages.
- Damages for loss of profits, revenue, goodwill, data, use, or other intangible losses.
- Damages arising from your access to, use of, or inability to access or use the Platform or any services provided through it.
- Damages arising from any clinical decision, act, or omission by an independent provider.
- Damages arising from any unauthorized access to or use of your account or personal information.
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ANTHOLOGYRX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Cap on Liability: In all cases, AnthologyRX's total aggregate liability to you for any claims arising from or related to your use of the Platform shall not exceed the total fees paid by you to AnthologyRX in the three (3) calendar months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. To the extent that applicable law does not permit such exclusions or limitations, they shall apply to the maximum extent permitted by law.
Section 11 Indemnification
You agree to defend, indemnify, and hold harmless AnthologyRX and its officers, directors, employees, agents, affiliates, licensors, service providers, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms or any applicable law or regulation.
- Your misuse of the Platform or any services made available through it.
- Your provision of false, inaccurate, incomplete, or misleading information in connection with your health intake assessment or account registration.
- Your violation of any third party's rights, including intellectual property rights or rights of privacy.
- Any claim by a third party arising from your conduct in connection with the Platform.
AnthologyRX reserves the right to assume exclusive control of the defense and settlement of any matter otherwise subject to indemnification by you. You agree to cooperate with AnthologyRX in the defense of such matters and not to settle any such matter without the prior written consent of AnthologyRX.
Section 12 Arbitration & Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
Binding Arbitration. Except for disputes that qualify for small claims court, you and AnthologyRX agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Platform, or any services or products provided through the Platform shall be resolved exclusively through final and binding arbitration, rather than in court.
- Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as amended by these Terms. The AAA's rules and filing instructions are available at www.adr.org.
- Arbitration shall be conducted in Los Angeles, California, unless the parties agree otherwise or the arbitrator determines that in-person hearing is unnecessary.
- The arbitrator shall have authority to award any remedy that a court of competent jurisdiction could award, including injunctive relief, but may not award remedies that exceed those permitted by these Terms.
- The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You and AnthologyRX each agree that any dispute resolution proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. Neither you nor AnthologyRX may bring any claim as part of a class action, class arbitration, private attorney general action, or other representative proceeding. This waiver is an essential term of this arbitration agreement.
Governing Law. These Terms and any dispute arising out of or relating to these Terms or the Platform shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict of law principles. For any disputes not subject to arbitration (including those that qualify for small claims court), you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
Opt-Out Right. You may opt out of the binding arbitration agreement within 30 days of first accepting these Terms by sending written notice of your decision to opt out to legal@anthologyrx.com with the subject line "Arbitration Opt-Out." If you opt out, neither you nor AnthologyRX will be bound by the arbitration provisions of this section; all disputes shall then be subject to the exclusive jurisdiction of courts located in Los Angeles County, California.
Section 13 Changes to Terms
AnthologyRX reserves the right to modify, amend, or replace these Terms at any time in its sole discretion. When changes are made, the updated Terms will be posted at anthologyrx.com/terms with an updated "Last Updated" date.
- Material changes — including changes that materially affect your rights, the scope of services, subscription pricing, or the arbitration agreement — will be communicated to you with at least 30 days' advance notice via the email address associated with your account or via a prominent notice on the Platform.
- Non-material changes (including clarifications, typographical corrections, and changes required by law) may take effect immediately upon posting without prior notice.
- Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of the Platform and cancel your subscription before the effective date of the changes.
It is your responsibility to review these Terms periodically. AnthologyRX will not be liable for any failure to notify you of changes if you have not provided a current, valid email address.
